Terms of service

These Terms of Service (“Terms”) govern the purchase, booking and use of services, packages, memberships, products and other offerings provided by LymphAddict (“LymphAddict,” “we,” “us,” or “our”), as well as use of the LymphAddict website and online booking platforms.

By accessing our website, booking an appointment, purchasing a service, package, membership or product, or otherwise receiving services from LymphAddict, you acknowledge that you have read, understood and agreed to these Terms, together with any applicable consent forms, intake forms, booking policies and other policies communicated to you.

Nothing in these Terms is intended to limit any rights or remedies that cannot legally be waived under applicable Ontario or Canadian law.

1. SERVICES

LymphAddict is a private wellness studio offering services that may include, but are not limited to:

• Manual lymphatic drainage;
• Brazilian lymphatic drainage;
• Preoperative and postoperative care;
• Body contouring and sculpting;
• Radiofrequency treatments;
• Ultrasonic cavitation;
• Wood therapy and other body-sculpting techniques;
• Red light therapy;
• Compression and postoperative support;
• Wellness services and related add-ons; and
• Other services, products, packages and programs offered from time to time.

Specific services, pricing, duration, eligibility and availability may change without notice.

2. NOT MEDICAL CARE

Unless expressly stated otherwise, LymphAddict services are wellness and aesthetic services and are not intended to diagnose, treat, cure or prevent disease or replace care from a physician or other regulated healthcare professional.

LymphAddict is not a Registered Massage Therapy (“RMT”) clinic and does not represent its services as RMT services.

Clients are responsible for determining whether their insurer, health spending account or other benefit provider will reimburse any service. LymphAddict does not guarantee insurance eligibility, reimbursement or coverage.

Where medical clearance is appropriate or requested, the client is responsible for obtaining such clearance before treatment.

3. CLIENT HEALTH INFORMATION & DISCLOSURE

Clients must provide complete and accurate information regarding their health, medical history, medications, recent surgeries, pregnancy status, contraindications and any other information reasonably relevant to the safe provision of services.

Clients must promptly notify LymphAddict of any material change in their health or medical condition before receiving further treatment.

Failure to disclose relevant medical or health information may result in a treatment being modified, postponed or refused.

LymphAddict reserves the right to require medical clearance before providing or continuing any service where reasonably considered appropriate for the client’s safety.

4. RESULTS & TREATMENT EXPECTATIONS

Individual results vary.

No particular outcome, measurement, appearance, recovery timeline, reduction in swelling, body-contouring result or other result is guaranteed.

Factors including anatomy, health, lifestyle, surgical procedure, surgeon technique, postoperative compliance, compression, hydration, activity, BMI, healing response and treatment consistency may affect outcomes.

Before-and-after photographs, testimonials and results shown by LymphAddict represent individual client experiences and are not guarantees of what another client will experience.

Clients acknowledge that multiple sessions may be recommended and that purchasing or receiving treatment does not guarantee a specific result.

5. BOOKINGS & PAYMENT

Appointments are reserved specifically for each client.

Payment requirements may vary depending on the service, package or promotion. LymphAddict may require full payment, partial payment, a deposit or a valid payment card to reserve an appointment.

By providing payment information, you authorize LymphAddict and its payment processors to charge amounts that you have agreed to pay, including applicable cancellation or no-show charges where authorized by these Terms and applicable law.

Prices are subject to change. A price change will not retroactively alter the price of a completed purchase unless otherwise agreed or required by law.

6. CANCELLATIONS, RESCHEDULING & NO-SHOWS

A minimum of 24 hours’ notice is required to cancel or reschedule an appointment.

Where less than 24 hours’ notice is provided, LymphAddict may charge 50% of the scheduled service price or deduct the applicable prepaid session, as communicated at the time of booking.

A no-show, meaning failure to attend an appointment without notice, may result in 100% of the scheduled service price being charged or the prepaid session being forfeited.

Late arrivals may result in a shortened appointment so that subsequent clients are not inconvenienced. The full scheduled service fee may still apply.

Repeated late cancellations, rescheduling, late arrivals or no-shows may result in future appointments being declined or advance payment being required.

Exceptions may be made by LymphAddict at its discretion and do not create an obligation to make the same exception in the future.

7. PACKAGES & DISCOUNTED SERVICES

Packages are priced based on the client’s commitment to the number of sessions included in the package.

Unless otherwise stated at purchase, packages expire one year from the date of purchase.

Packages and unused sessions are non-transferable and may not be shared between clients unless LymphAddict expressly authorizes otherwise.

Package discounts are conditional upon completion of the package commitment.

If a client voluntarily chooses to discontinue a discounted package before completing the required number of sessions and LymphAddict agrees to provide a discretionary partial refund, sessions already completed may be recalculated at the regular individual session price in effect when the package was purchased. Any approved refund would then be calculated from the remaining balance after completed services and any other applicable amounts have been deducted.

Nothing in this section limits a refund, cancellation or other remedy to which a consumer is legally entitled under applicable law.

8. REFUNDS

Except where required by law or expressly provided in these Terms, purchases of completed services, prepaid appointments, packages, memberships, promotional offers and digital products are final sale.

Services that have already been performed are not refundable merely because a client is dissatisfied with a subjective result or because the client’s desired outcome was not achieved.

Where LymphAddict voluntarily agrees to issue a refund that is not otherwise legally required, LymphAddict may reasonably account for services already provided, discounts that were conditional upon a package commitment, products supplied, processing costs where legally permitted, and other amounts properly owing under the agreement.

Approved refunds will be returned through an appropriate payment method within a reasonable processing period.

This refund policy does not exclude, restrict or override any non-waivable rights or remedies available under applicable consumer protection legislation.

9. RIGHT TO REFUSE, MODIFY OR DISCONTINUE SERVICE

LymphAddict reserves the right to decline, modify, postpone, discontinue or terminate services or the client-provider relationship where reasonably considered appropriate.

This may include, without limitation, circumstances involving:

• Abusive, threatening, aggressive, intimidating, discriminatory, harassing or inappropriate conduct;
• Disrespectful, hostile or persistently confrontational behaviour toward LymphAddict, its owner, staff, contractors, other clients or visitors;
• Sexual comments, advances, requests, touching or other inappropriate conduct;
• Repeated disregard for professional boundaries;
• Repeated violations of booking, cancellation, payment, studio or treatment policies;
• Fraudulent activity, suspected fraud, unauthorized payment disputes or chargebacks;
• Failure or refusal to pay amounts legitimately owing;
• Providing false, misleading or materially incomplete information;
• Failure to disclose information relevant to treatment safety;
• Failure to follow reasonable safety requirements;
• A medical contraindication or other health or safety concern;
• A request for a service that LymphAddict considers inappropriate, unsafe or outside its scope of practice;
• Conduct that causes LymphAddict to reasonably feel unsafe or unable to provide services professionally;
• A significant breakdown in trust, communication or the professional client-provider relationship;
• Repeated unreasonable demands or conduct that substantially interferes with LymphAddict’s ability to operate its business or serve other clients; or
• Any other legitimate business, professional, ethical or safety reason for which continuing the relationship would no longer be reasonably appropriate.

LymphAddict is not required to tolerate abusive, threatening, harassing or inappropriate conduct as a condition of continuing to provide services.

Where appropriate, LymphAddict may terminate the client-provider relationship immediately and cancel future appointments.

Nothing in this section permits LymphAddict to refuse services for a reason prohibited by the Ontario Human Rights Code or other applicable law.

10. TERMINATION OF A CLIENT RELATIONSHIP & PREPAID BALANCES

If LymphAddict terminates a client relationship, all future appointments may be cancelled immediately.

Where the client has prepaid for services that have not yet been provided, LymphAddict will determine the remaining account balance in accordance with the applicable package terms, services already rendered and applicable law.

Unless prohibited by law, amounts legitimately owing to LymphAddict may be deducted from any refundable balance.

Where LymphAddict terminates the relationship for business or professional reasons unrelated to misconduct by the client, unused prepaid amounts for services LymphAddict will no longer provide will generally be refunded, subject to applicable law and any services already rendered.

Where termination results from a client’s misconduct, policy violation, non-payment, abusive behaviour or other breach of these Terms, LymphAddict reserves all rights and remedies available under these Terms and applicable law. Any refund or balance owing will be determined in accordance with the original purchase terms and applicable law.

Termination of the relationship does not eliminate amounts properly owing for services already provided, valid cancellation/no-show charges or other obligations incurred before termination.

11. CLIENT CONDUCT & PROFESSIONAL BOUNDARIES

LymphAddict is committed to maintaining a safe, respectful and professional environment.

Clients are expected to communicate respectfully and behave appropriately during all interactions, including in person, by telephone, email, text message, social media and online booking communications.

Harassment, threats, intimidation, verbal abuse, discriminatory remarks, sexual misconduct, repeated hostile communication or other inappropriate behaviour will not be tolerated.

LymphAddict may end a session immediately if a client’s conduct makes continuing the treatment unsafe or inappropriate.

Depending on the circumstances, the session may be considered used where treatment has already begun or where the termination resulted from the client’s misconduct, subject to applicable law.

12. POSTOPERATIVE SERVICES

Postoperative care is intended to support recovery and does not replace postoperative medical care provided by the client’s surgeon or healthcare team.

Clients must follow their surgeon’s medical instructions.

LymphAddict may decline, postpone or modify postoperative treatment if there are signs or symptoms that may require medical assessment, including suspected infection, blood clot, wound complication, uncontrolled bleeding, unusual swelling or other concerning symptoms.

Where appropriate, the client may be directed to contact their surgeon, physician or emergency medical services before treatment can continue.

Any procedure that legally requires a regulated healthcare professional will only be performed by an appropriately qualified professional.

13. MINORS

Unless expressly agreed otherwise, clients must be at least 18 years of age to independently consent to and purchase services.

Where LymphAddict agrees to provide an appropriate service to a minor, consent from a parent or legal guardian may be required.

LymphAddict reserves the right to decline any service to a minor where the requested treatment is considered inappropriate.

14. PERSONAL BELONGINGS

Clients are responsible for their personal belongings while attending the studio.

To the extent permitted by law, LymphAddict is not responsible for lost, stolen or damaged personal property unless caused by circumstances for which liability cannot legally be excluded.

15. PHOTOGRAPHY, TESTIMONIALS & MARKETING

Client photographs, videos, testimonials or identifying treatment results will not be used for marketing purposes without the client’s applicable consent.

Where a client has provided consent, the scope of use will be governed by the applicable consent obtained.

Clinical or treatment documentation may be maintained separately as reasonably required for client records, safety and business administration, subject to applicable privacy requirements.

16. PRIVACY

Personal information collected by LymphAddict will be handled in accordance with applicable privacy requirements and any privacy policy maintained by LymphAddict.

Information may be collected for purposes including booking appointments, processing payments, communicating with clients, maintaining treatment records, providing services and complying with legal obligations.

17. CHARGEBACKS & PAYMENT DISPUTES

Clients are encouraged to contact LymphAddict directly regarding billing concerns so that legitimate issues can be investigated and addressed.

A chargeback or payment dispute does not automatically eliminate an amount legitimately owing under these Terms.

LymphAddict reserves the right to provide relevant booking records, signed agreements, communications, transaction records, attendance records and other appropriate documentation to payment processors or financial institutions when responding to a payment dispute.

Fraudulent or abusive use of the chargeback process may result in termination of the client relationship and refusal of future bookings, subject to applicable law.

Nothing in this section limits a client’s lawful right to dispute an unauthorized or improper charge.

18. GIFT CARDS, PROMOTIONS & DISCOUNTS

Gift cards, promotional offers and discounts are subject to any additional terms stated when offered.

Promotional pricing cannot be combined with other offers unless expressly permitted.

Promotional discounts have no standalone cash value.

Any expiry date or other restriction will be applied only to the extent permitted by applicable law.

19. WEBSITE & INTELLECTUAL PROPERTY

All original content on the LymphAddict website and associated business platforms, including photographs, graphics, branding, logos, written materials, treatment descriptions, educational materials, downloadable resources and other original content, is owned by or licensed to LymphAddict unless otherwise stated.

Content may not be copied, reproduced, distributed, sold, republished or commercially used without permission except where permitted by law.

20. THIRD-PARTY SERVICES & LINKS

LymphAddict may use or link to third-party platforms for booking, payment processing, communications, product purchases or other services.

Those third parties may have separate terms and privacy policies.

LymphAddict is not responsible for third-party platforms to the extent their operation is outside LymphAddict’s reasonable control.

21. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, LymphAddict will not be liable for indirect, incidental, special or consequential losses arising from use of the website, products or services.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Clients remain responsible for following treatment instructions, disclosing relevant health information and seeking appropriate medical care where required.

22. INDEMNIFICATION

To the extent permitted by law, clients agree to indemnify and hold harmless LymphAddict and its owners, employees, contractors and representatives from claims, losses or expenses arising from the client’s material breach of these Terms, unlawful conduct or intentional provision of materially false information, except to the extent caused by LymphAddict’s own negligence, misconduct or other liability that cannot legally be excluded.

23. CONSUMER PROTECTION

These Terms are subject to applicable consumer protection legislation.

Nothing in these Terms is intended to waive, restrict or eliminate any consumer right, statutory warranty, cancellation right, refund entitlement or remedy that cannot legally be waived or restricted.

If any provision of these Terms conflicts with a mandatory requirement of applicable law, the mandatory legal requirement will prevail.

24. GOVERNING LAW

These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada.

25. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be interpreted or removed to the minimum extent necessary, and the remaining provisions will continue in effect.

26. CHANGES TO THESE TERMS

LymphAddict may update these Terms periodically to reflect changes to its services, policies, business practices or applicable law.

The version posted on the website will display the date it was last updated.

Changes will apply prospectively from their effective date and will not be used to retroactively remove rights or materially alter obligations relating to transactions completed before the change where doing so would be prohibited by law.

27. ACKNOWLEDGEMENT

By booking or purchasing services from LymphAddict, you acknowledge that you have had an opportunity to review the applicable terms and policies and agree to comply with them.

You further acknowledge that maintaining a respectful and professional client-provider relationship is a condition of continuing to receive services from LymphAddict.
